1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and ShaadiGujarat ("Company", "we", "us") governing your use of our website at https://thewebstori.com/ and all related services. By registering an account, listing a business, making a booking or simply browsing the Platform, you accept these Terms in full.

These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019 and other applicable regulations.

2. Definitions

• "Platform" — The ShaadiGujarat website, mobile site and all related services.
• "User" / "Couple" — Any person who registers or browses the Platform to find wedding vendors.
• "Vendor" — Any business or individual who lists their wedding services on the Platform.
• "Listing" — A vendor's profile page on the Platform including their details, photos and pricing.
• "Booking" — A confirmed reservation between a User and a Vendor facilitated through the Platform.
• "Advance" — A partial payment made by a User to a Vendor to confirm a booking.
• "Content" — Any text, photos, videos, reviews or other material submitted to the Platform.

3. Eligibility & Accounts

• You must be at least 18 years old to register an account or make bookings on the Platform.
• You must provide accurate, complete and current registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at hello@shaadigujarat.in if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
• One person or business may not maintain multiple accounts without written permission from us.

4. Vendor Listings

Vendors who list their business on ShaadiGujarat agree to the following:

• All information provided in your listing — name, description, photos, pricing and contact details — must be accurate, truthful and up to date.
• You must have the right to use all photos and content submitted to your listing.
• Your listing must represent your actual business and services.
• Pricing shown on the listing must be real and achievable. Hidden charges or bait-and-switch pricing are prohibited.
• ShaadiGujarat reserves the right to review, approve, edit or remove any listing that violates these Terms or our quality standards.
• Vendors are responsible for responding to enquiries in a timely and professional manner.
• Vendors must honour confirmed bookings unless both parties mutually agree otherwise.
• We do not guarantee a specific number of enquiries, bookings or revenue from your listing.

5. Bookings & Payments

• Bookings are facilitated between Users and Vendors. ShaadiGujarat acts as a platform intermediary — we are not a party to the vendor-client contract.
• Advance payments are processed via Razorpay and are subject to Razorpay's terms of service.
• Refund Policy: Refunds are subject to the individual vendor's cancellation policy agreed at the time of booking. ShaadiGujarat will assist in facilitating refunds where technically possible, but cannot guarantee refunds from vendors.
• If a vendor cancels a confirmed booking, the advance payment will be refunded to the user within 7–10 business days.
• ShaadiGujarat does not charge commission on bookings. The advance amount goes directly to the vendor via Razorpay.
• Balance payments (remaining amount beyond the advance) are made directly between the user and vendor outside the Platform.
• We are not responsible for disputes arising from payments made outside the Platform.

6. User Conduct & Prohibited Activities

You agree not to use the Platform for any of the following:

• Submitting false, misleading or fraudulent information.
• Impersonating another person, business or ShaadiGujarat staff.
• Posting fake reviews or paying for fake reviews.
• Contacting vendors for purposes unrelated to wedding services.
• Spamming, harassing or threatening any user, vendor or staff member.
• Attempting to bypass, exploit or attack our technical systems.
• Scraping, copying or redistributing Platform content without permission.
• Using the Platform in violation of any applicable Indian or international law.
• Soliciting vendors to transact outside the Platform to avoid legitimate bookings.
• Uploading viruses, malware or other harmful code.

7. Reviews & Content

• Reviews must be based on a genuine personal experience with the vendor.
• Reviews must not contain defamatory, obscene, hateful or legally actionable statements.
• Vendors may not submit reviews for their own listing or for competitor listings.
• We reserve the right to moderate, edit or remove any review or content that violates these Terms.
• By submitting content (photos, reviews, descriptions), you grant ShaadiGujarat a non-exclusive, royalty-free, worldwide licence to use, display and distribute that content on the Platform and in marketing materials.
• You confirm that you own or have the right to use all content you submit.
• You may request removal of your submitted content by contacting us, except where retention is required by law or legitimate interest.

8. Intellectual Property

All content on ShaadiGujarat — including the logo, brand name, website design, code, graphics, text and compiled vendor data — is the property of ShaadiGujarat and is protected under Indian intellectual property laws.

• You may not copy, reproduce, distribute or create derivative works from our content without written permission.
• Vendor photos and descriptions remain the property of the respective vendors.
• The ShaadiGujarat name, logo and brand marks may not be used without prior written consent.

9. Disclaimer of Warranties

We do not vet, endorse or guarantee the quality of any vendor's services. The relationship is between you and the vendor directly. We are not liable for any dissatisfaction with vendor services, cancelled events or disputes between users and vendors.

10. Limitation of Liability

To the maximum extent permitted by applicable law, ShaadiGujarat and its directors, employees and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential or punitive damages.
• Loss of revenue, profits, data or business opportunity arising from use of the Platform.
• Vendor performance, quality of services, event cancellations or vendor disputes.
• Unauthorised access to or alteration of your data despite reasonable security measures.
• Temporary unavailability of the Platform due to maintenance or technical issues.

Our total liability to you for any claim arising from these Terms or use of the Platform shall not exceed the amount paid by you to ShaadiGujarat in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ShaadiGujarat, its directors, employees and agents from any claims, losses, damages, liabilities and expenses (including legal fees) arising from:

• Your use of the Platform in violation of these Terms.
• Content you submit that infringes a third party's rights.
• Your interactions with vendors or other users.
• Any misrepresentation you make on the Platform.

12. Termination

• You may delete your account at any time by contacting us at hello@shaadigujarat.in.
• We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or cause harm to other users or vendors.
• On termination, your access to the Platform ceases. Pending bookings and payments will be handled as per Section 5.
• Vendor listings will be removed within 7 business days of account termination.
• Sections 8, 9, 10 and 11 survive termination.

13. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for at least 30 days. If unresolved, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996 with a sole arbitrator appointed by mutual agreement.

14. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email to registered users and displayed prominently on the Platform. Continued use after the effective date constitutes acceptance of the updated Terms. The "Last updated" date at the top always reflects the current version.
